        Governing Docs


Members of the Hunters Green Cluster Association are subject to the provisions of six sets of governing documents in descending order of applicability as follows:

  • "The Virginia Nonstock Corporation Act" as codified in Title 13.1, Chapter 10, Sections 13.1 through 13.1-944 of the Code of the Commonwealth of Virginia.  to go to the Commonwealth of Virginia's web site to view a hyperlinked copy of the Act.
  • "The Virginia Property Owners’ Association Act" as codified in Title 55, Chapter 26, Sections 55-508 through 55-516.2 of the Code of the Commonwealth of Virginia.  to go to the Commonwealth of Virginia's web site to view a hyperlinked copy of the Act.

  • The Governing Documents of the Reston Association.   to go to Reston Association's web site to view the documents.  The portion of the Amended Deed of Dedication pertaining to Clusters is found in Article VII and begins on page 41 of the PDF File. 

  • The "Articles of Incorporation of the Hunters Green Cluster Association." 

  • The "By-laws of the Hunters Green Cluster Association." 

  • Resolutions of the Board of Directors. Currently, the Board has two resolutions in effect:

In general, the provisions in the higher documents are in effect when the lower documents are "silent" in that regard.  A provision in a lower document takes precedence when it is more restrictive than a similar provision in a higher document, but can not be less restrictive. For example, if the state law says that the required period for advance notice of a meeting is 10 days, the Association by-laws could opt to establish a 14-day minimum requirement, but could not establish a less restrictive 7-day requirement.
